Larry McKelvey, a Dallas Cowboys fan caught on tape using his stun gun on three people at Sunday night's Jets game, is defending his awful conduct.

The New York Daily News reports a group of Gang Green fans disapproved when McKelvey failed to stand for the national anthem and talked on his cell phone during a moment of silence for 9/11 victims. The 59-year-old said "I did what I had to do." He claims he's not a "criminal" and was just protecting himself.

The condemned Cowboys fan was released on $22,500 bail Monday night from a New Jersey jail. McKelvey's son, a New York radio deejay, told the newspaper it's against his Jehovah Witness father's religious beliefs to stand for the national anthem.

Police charged the man with three counts of aggravated assault and illegal possession of a stun gun.

Power 105.1's Charlamagne Tha God, McKelvey's son, says his old man walked right past security with the stun gun on his hip, rather than sneaking it by clueless security guards.

A witness told the Daily News that McKelvey was being "obnoxious," and chatted with friends during "Taps." When he attempted to get up and use the restroom, nobody would let him out. That led to some mean-spirited words and the use of the taser.

Personally, I have pretty mixed feelings about this whole thing.

My thoughts exactly. Part of me says I would have been in his shit about that too. To be chatting on your cell phone during a moment of silence for lost ones is probably one of the most disrespectful things I can think of.

He doesn't have to stand for the anthem (or sing it), but he should be quiet during a moment of silence. If you want people to respect your beliefs, you have to respect theirs.

Mutual rights are at odds with one another.

The persons right not to stand in silence and the right not to respect the national anthem

and

The persons right to stand in silence and the right to respect the national anthem.

Neither right is stronger than the other, in the constitutional sense. And, niether has the right to infringe the right of the other.

If you want to talk.....equal respect, than BOTH of these rights need to be respected.

This person living in the US has the freedom not to stand or honor the National anthem. In addition, he has the individual right not to honor the silence for 9/11 (no matter how bad it speaks to moral relevancy, and decency). And the person does have the right not to be criminally encroached by another when executing a common right.

This person WAS NOT breaking any criminal laws, but only broke what some would define as breaking moral code and human decency. Since his morally questioned conduct was not breaking any criminal law, and he was a paying fan, he had the right to be where he was though his conduct violated the moral conduct code of those around him.

This outward act was non-criminal nor violated the rules as it relates to code of conduct at the stadium, but brought out actions that did turn criminally wrong or bring a violation of conduct that can be deemed as criminal, and can be bring prosecutable offenses.

The "spirit" of the law would deem this non-criminal and speak to the moral code of conduct, and no prosecution should take place. The "letter" of the law, would be the opposite.

We have to remember some things. If you are confronted with an angry person (for what ever reason, that is NOT your fault), it is your right to defend yourself---to the point ONLY that the aggression stops. You can be BECOME the primary physical aggressor once the aggression was stopped by you---if you continually beat the person causing undue bodily harm or death, you can be prosecuted. Most people do not understand this concept in self defense and the law (at least in Kansas).

Out of respect and moral decency most would have kept off the phone, or put it down and kept quiet. But the bottom line is......he is not required to. Like it or not. And, the reaction of the other person (s), isn't right either, but most will point to the guy not being quiet as the idiot. Is this true, really?

Moral justification does not make ones reaction the correct one. In addition moral values and criminal acts can be separate issues.

Agree.

Breaking this code of respect is a low thing to do. This does not mean he deserves retribution, obviously. But he is an asshat. I will say this though...if you do something despicable in public, someone will most likely react. Not saying this is how it should be, but it is how it is.
